1. Agreement to Terms

By accessing or using BudgetBloom ("the Service"), operated by BudgetBloom, LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service. These terms apply to all visitors, users, and others who access or use the Service at budgetbloom.app.

2. Account Terms

You must be at least 18 years of age to use this Service. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account and keep this information up to date. You may not use the Service for any illegal or unauthorized purpose. A single person or legal entity may not maintain more than one free account. We reserve the right to refuse service, suspend accounts, or remove content at our sole discretion.

3. Acceptable Use

You agree not to misuse the Service or help anyone else do so. You may not do any of the following in connection with the Service:

• Attempt to probe, scan, or test the vulnerability of the Service or breach any security or authentication measures
• Access, tamper with, or use non-public areas of the Service, our computer systems, or the technical delivery systems of our providers
• Interfere with or disrupt any user, host, or network access, including sending viruses, overloading, flooding, or spamming the Service
• Use the Service to send altered, deceptive, or false source-identifying information
• Use the Service for any illegal activity, including money laundering, fraud, or financing of terrorism
• Scrape, data-mine, or extract data from the Service through automated means

4. Subscription and Billing

Some features of the Service require a paid subscription. By subscribing to a paid plan, you agree to pay the applicable fees as described at the time of purchase. Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your selected plan). Your subscription will automatically renew at the end of each billing period unless you cancel it before the renewal date. You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. Refunds are handled on a case-by-case basis at our discretion. We reserve the right to change subscription pricing with 30 days' notice.

5. Financial Data and Third-Party Services

BudgetBloom integrates with third-party financial data providers, including Plaid, to access your financial account information. When you connect a financial account, you authorize us and our third-party partners to access, collect, and use your financial data as described in our Privacy Policy. We do not store your bank login credentials. The Service is a financial management tool and does not provide financial, investment, tax, or legal advice. You should consult with qualified professionals before making financial decisions.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by BudgetBloom, LLC and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to use, process, and display your data solely to provide the Service to you.

7. Limitation of Liability

To the maximum extent permitted by law, BudgetBloom, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your use of or inability to use the Service; (b) unauthorized access to or alteration of your data; (c) any third-party conduct on the Service; or (d) any other matter related to the Service. Our total liability for any claim arising out of or relating to these terms or the Service shall not exceed the amount you paid us during the twelve (12) months prior to the claim.

8. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any financial data displayed will be accurate or complete.

9. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us or through your account settings. Upon termination, we will make reasonable efforts to delete your data within 30 days, unless retention is required by law.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these terms or the Service shall be resolved exclusively in the state or federal courts located in the State of Delaware.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to the new terms taking effect. By continuing to access or use the Service after revisions become effective, you agree to be bound by the revised terms.
